This document is a public offer (Art. 437 of the Civil Code of the Russian Federation) by a self-employed individual, Gordeev Vitaly Sergeevich (Гордеев Виталий Сергеевич) (INN 631218094886, Federal Law No. 422-FZ "On the Professional Income Tax"; hereinafter the Cloud Delight Studio or the Studio), and sets out the terms for purchasing digital products and ordering services through the website cloud-delight.ru. By placing an order or paying for a product, you (the Buyer) accept the terms of this offer in full.
Definitions
- Studio — Gordeev Vitaly Sergeevich (Гордеев Виталий Сергеевич), self-employed, INN 631218094886, owner of the website cloud-delight.ru.
- Site — cloud-delight.ru.
- Buyer — an individual or legal entity placing an order on the Site or through the Studio's official channels.
- Digital product — a plugin, server configuration, website template, map build, ready-made design, and other results of intellectual activity in the form of files.
- Custom service — custom plugin development, server build, design, or construction work performed to the Buyer's technical specification.
- Official channels: the Site cloud-delight.ru; vk.com/cloud_delight; Telegram @vitaldemort; Discord; email cloud.delight@yandex.ru.
- Specification — the technical specification, an agreed document setting out the requirements for a custom service.
1. Subject matter
The Studio sells digital products and provides development services for the Minecraft platform: plugins, server builds, websites, builds, and design.
Digital products are purchased through the Site catalog with automatic delivery after payment.
Custom services are discussed and agreed separately through the official channels.
All payments are made in Russian rubles through the YooKassa service; a receipt under Federal Law No. 422-FZ is generated automatically.
2. Placing and paying for an order
Digital products from the catalog
- The Buyer selects a product on the Site and adds it to the cart.
- The checkout page asks for an email address, to which the product will be sent.
- Payment is made through YooKassa (card, Faster Payments System, and other available methods). Payment details are processed exclusively by YooKassa and are not transmitted to the Site.
- After successful payment, the download link (a file or a Yandex.Disk link) is sent automatically to the email address provided.
- A self-employed receipt is generated in the "My Tax" system and sent to the Buyer.
Custom services
- The Buyer contacts the Studio through any official channel and describes the task.
- The Studio proposes terms: price, timeline, payment method, and specification format.
- An order is deemed accepted after the specification is agreed and a prepayment is made in the amount stated by the Studio (usually 50%).
- Final handover of the result takes place after full payment.
The prices stated on the Site may be changed by the Studio at any time. Orders that have already been paid for are performed at the price at which they were paid.
3. Delivery of digital products
Digital products from the catalog are delivered automatically to the Buyer's email address immediately after YooKassa confirms the payment. Delivery usually takes a few minutes.
If the email has not arrived within an hour, check your "Spam" folder and write to cloud.delight@yandex.ru stating your email address and the time of payment.
The results of custom services are handed over by the method agreed in the specification (Yandex.Disk, direct file upload, server access).
4. Refunds and exchanges
Digital products are goods of proper quality and are not subject to return on the ground that they "did not fit", in accordance with Art. 26.1 of the Russian Federation Law "On Consumer Rights Protection" and Russian Government Resolution No. 2463 of December 31, 2020.
A refund is possible in the following cases:
- the product was not delivered within 24 hours after payment and the Studio was unable to resolve the problem;
- the product has a material defect that cannot be remedied and is not related to the configuration of the Buyer's server or its compatibility with the Buyer's build;
- the Studio has declined to perform a custom order before work has begun.
A refund request is submitted by email to cloud.delight@yandex.ru within 14 days of purchase, with a description of the problem and the receipt attached.
The refund is made to the same account details from which the payment was made, within 10 business days of the refund being confirmed.
For custom services: once work has begun, a refund of the prepayment is possible only for the unperformed part, by agreement of the parties.
When a promo code or a promotional price was used, the refund is made in the amount actually paid.
5. Rights to deliverables
By purchasing a digital product or ordering a service, the Buyer receives a simple (non-exclusive) license to use the result in the Buyer's own projects.
The following is prohibited:
- reselling, transferring, or publishing in open access ("leaking") purchased products;
- passing off the Studio's work as one's own;
- using decompiled source code in derivative commercial products without the Studio's separate written permission.
Exclusive rights to the Studio's products and materials remain with the Studio (Arts. 1229 and 1235 of the Civil Code of the Russian Federation).
If violations are identified, the Studio may terminate technical support and refuse further service without a refund.
6. Technical support
For purchased digital products, the Studio provides free technical support to a reasonable extent:
- consultations on installation and configuration;
- fixing bugs in the original version of the product;
- restoring files in case of a failure on the Studio's side.
Technical support does not cover:
- problems caused by the Buyer's modification of files;
- incompatibility with other plugins and builds not listed in the product description;
- configuration of third-party software that is not part of the Studio's product.
Support requests are handled through the official channels.
7. Liability
The Studio is not liable for:
- incompatibility of products with a specific version of Minecraft, server core (Spigot, Paper, Purpur, etc.), or third-party plugins, where the version requirements are stated in the product description;
- loss of data on the Buyer's server;
- actions of third parties who have gained access to the Buyer's products;
- downtime of hosting and third-party services (YooKassa, Yandex.Disk, VK, etc.).
The Buyer is responsible for the lawfulness of using the purchased products in the Buyer's projects.
The Studio's aggregate liability to the Buyer under any claim shall not exceed the amount actually paid by the Buyer for the relevant product or service.
The parties are released from liability in the event of force majeure.
8. Communication with the Studio
All work-related matters are resolved through the official channels.
The following are prohibited in communication: obscene language, threats, flooding, and attempts to obtain free services under the guise of a "test assignment".
In the event of a violation, the Studio may refuse to continue work and block the Buyer in its channels. If work has already begun, the prepayment is not refunded.
9. Amendment and termination
The Studio may amend the terms of this offer. The new version takes effect upon publication on the Site.
For orders that have already been placed and paid for, the version in force at the time of payment applies.
The Buyer may cancel an order before its performance begins (see clause 4).
10. Governing law and disputes
The relations of the parties are governed by the legislation of the Russian Federation.
All disputes are resolved through negotiations. A written claim is reviewed within 30 calendar days of receipt.
If no agreement is reached, the dispute is referred to the court at the Studio's location in accordance with the applicable legislation of the Russian Federation.
